class=\"ng-star-inserted\">Article 1 \u2013 Definitions<\/span><\/strong><\/p><ul class=\"ng-star-inserted\"><li class=\"ng-star-inserted\"><p class=\"ng-star-inserted\"><strong class=\"ng-star-inserted\"><span class=\"ng-star-inserted\">Cooling-off period:<\/span><\/strong><span class=\"ng-star-inserted\">\u00a0the period within which the consumer can make use of his right of withdrawal;<\/span><\/p><\/li><li class=\"ng-star-inserted\"><p class=\"ng-star-inserted\"><strong class=\"ng-star-inserted\"><span class=\"ng-star-inserted\">Consumer:<\/span><\/strong><span class=\"ng-star-inserted\">\u00a0the natural person not acting in the exercise of a profession or business who enters into a distance agreement with the entrepreneur;<\/span><\/p><\/li><li class=\"ng-star-inserted\"><p class=\"ng-star-inserted\"><strong class=\"ng-star-inserted\"><span class=\"ng-star-inserted\">Day:<\/span><\/strong><span class=\"ng-star-inserted\">\u00a0calendar day;<\/span><\/p><\/li><li class=\"ng-star-inserted\"><p class=\"ng-star-inserted\"><strong class=\"ng-star-inserted\"><span class=\"ng-star-inserted\">Long-term transaction:<\/span><\/strong><span class=\"ng-star-inserted\">\u00a0a distance agreement relating to a series of products and\/or services, for which the delivery and\/or purchase obligation is spread over time;<\/span><\/p><\/li><li class=\"ng-star-inserted\"><p class=\"ng-star-inserted\"><strong class=\"ng-star-inserted\"><span class=\"ng-star-inserted\">Durable medium:<\/span><\/strong><span class=\"ng-star-inserted\">\u00a0any means that enables the consumer or entrepreneur to store information addressed personally to them in a way that allows future consultation and unaltered reproduction of the stored information;<\/span><\/p><\/li><li class=\"ng-star-inserted\"><p class=\"ng-star-inserted\"><strong class=\"ng-star-inserted\"><span class=\"ng-star-inserted\">Right of withdrawal:<\/span><\/strong><span class=\"ng-star-inserted\">\u00a0the possibility for the consumer to waive the distance agreement within the cooling-off period;<\/span><\/p><\/li><li class=\"ng-star-inserted\"><p class=\"ng-star-inserted\"><strong class=\"ng-star-inserted\"><span class=\"ng-star-inserted\">Model form:<\/span><\/strong><span class=\"ng-star-inserted\">\u00a0the model withdrawal form provided by the entrepreneur that a consumer can fill in if they wish to exercise their right of withdrawal;<\/span><\/p><\/li><li class=\"ng-star-inserted\"><p class=\"ng-star-inserted\"><strong class=\"ng-star-inserted\"><span class=\"ng-star-inserted\">Entrepreneur:<\/span><\/strong><span class=\"ng-star-inserted\">\u00a0the natural or legal person who offers products and\/or services to consumers at a distance;<\/span><\/p><\/li><li class=\"ng-star-inserted\"><p class=\"ng-star-inserted\"><strong class=\"ng-star-inserted\"><span class=\"ng-star-inserted\">Distance agreement:<\/span><\/strong><span class=\"ng-star-inserted\">\u00a0an agreement whereby, within the framework of a system organized by the entrepreneur for the distance sale of products and\/or services, exclusive use is made of one or more techniques for distance communication up to and including the conclusion of the agreement;<\/span><\/p><\/li><li class=\"ng-star-inserted\"><p class=\"ng-star-inserted\"><strong class=\"ng-star-inserted\"><span class=\"ng-star-inserted\">Technique for distance communication:<\/span><\/strong><span class=\"ng-star-inserted\">\u00a0means that can be used for concluding an agreement without the consumer and entrepreneur having to meet simultaneously in the same room;<\/span><\/p><\/li><li class=\"ng-star-inserted\"><p class=\"ng-star-inserted\"><strong class=\"ng-star-inserted\"><span class=\"ng-star-inserted\">General Terms and Conditions:<\/span><\/strong><span class=\"ng-star-inserted\">\u00a0the present General Terms and Conditions of the entrepreneur.<\/span><\/p><\/li><\/ul><p class=\"ng-star-inserted\"><strong class=\"ng-star-inserted\"><span class=\"ng-star-inserted\">Article 2 \u2013 Identity of the Entrepreneur<\/span><\/strong><br class=\"ng-star-inserted\" \/><span class=\"ng-star-inserted\">TopshelfCBD; Waarderstraat 141, 2729 MB Applicability<\/span><\/strong><br class=\"ng-star-inserted\" \/><span class=\"ng-star-inserted\">These conditions apply to every offer from the entrepreneur and to every distance agreement and order concluded between entrepreneur and consumer.<\/span><\/p><p class=\"ng-star-inserted\"><strong class=\"ng-star-inserted\"><span class=\"ng-star-inserted\">Article 4 \u2013 The Offer<\/span><\/strong><br class=\"ng-star-inserted\" \/><span class=\"ng-star-inserted\">The offer contains a full and accurate description of the products\/services. Obvious mistakes or errors in the offer do not bind the entrepreneur. All images and specifications are indicative.<\/span><\/p><p class=\"ng-star-inserted\"><strong class=\"ng-star-inserted\"><span class=\"ng-star-inserted\">Article 5 \u2013 The Agreement<\/span><\/strong><br class=\"ng-star-inserted\" \/><span class=\"ng-star-inserted\">The agreement is concluded at the moment the consumer accepts the offer and meets the corresponding conditions.<\/span><\/p><p class=\"ng-star-inserted\"><strong class=\"ng-star-inserted\"><span class=\"ng-star-inserted\">Article 6 \u2013 Right of Withdrawal<\/span><\/strong><br class=\"ng-star-inserted\" \/><span class=\"ng-star-inserted\">When purchasing products, the consumer has the option to dissolve the agreement without giving reasons for 14 days, starting the day after receipt. During this period, the consumer must handle the product and packaging with care.<\/span><\/p><p class=\"ng-star-inserted\"><strong class=\"ng-star-inserted\"><span class=\"ng-star-inserted\">Article 7 \u2013 Costs in Case of Withdrawal<\/span><\/strong><br class=\"ng-star-inserted\" \/><span class=\"ng-star-inserted\">If the consumer exercises their right of withdrawal, they shall bear no more than the cost of returning the goods. The entrepreneur will refund the payment within 14 days of receiving the return.<\/span><\/p><p class=\"ng-star-inserted\"><strong class=\"ng-star-inserted\"><span class=\"ng-star-inserted\">Article 8 \u2013 Exclusion of Right of Withdrawal<\/span><\/strong><br class=\"ng-star-inserted\" \/><span class=\"ng-star-inserted\">The right of withdrawal can be excluded for specific products (e.g., custom-made goods, perishable goods, or sealed hygienic products where the seal has been broken).<\/span><\/p><p class=\"ng-star-inserted\"><strong class=\"ng-star-inserted\"><span class=\"ng-star-inserted\">Article 9 \u2013 Price<\/span><\/strong><br class=\"ng-star-inserted\" \/><span class=\"ng-star-inserted\">Prices will not be increased during the validity period stated in the offer, except for changes in VAT rates.<\/span><\/p><p class=\"ng-star-inserted\"><strong class=\"ng-star-inserted\"><span class=\"ng-star-inserted\">Article 10 \u2013 Conformity and Warranty<\/span><\/strong><br class=\"ng-star-inserted\" \/><span class=\"ng-star-inserted\">The entrepreneur guarantees that the products comply with the agreement and reasonable requirements of reliability and\/or usability.<\/span><\/p><p class=\"ng-star-inserted\"><strong class=\"ng-star-inserted\"><span class=\"ng-star-inserted\">Article 11 \u2013 Delivery and Execution<\/span><\/strong><br class=\"ng-star-inserted\" \/><span class=\"ng-star-inserted\">The entrepreneur will execute accepted orders with convenient speed but at the latest within 30 days, unless a longer delivery period has been agreed.<\/span><\/p><p class=\"ng-star-inserted\"><strong class=\"ng-star-inserted\"><span class=\"ng-star-inserted\">Article 12 \u2013 Long-term Transactions<\/span><\/strong><br class=\"ng-star-inserted\" \/><span class=\"ng-star-inserted\">The consumer can terminate an indefinite agreement at any time with an agreed notice period of no more than one month.<\/span><\/p><p class=\"ng-star-inserted\"><strong class=\"ng-star-inserted\"><span class=\"ng-star-inserted\">Article 13 \u2013 Payment<\/span><\/strong><br class=\"ng-star-inserted\" \/><span class=\"ng-star-inserted\">Unless otherwise agreed, amounts owed by the consumer must be paid within 7 working days after the start of the cooling-off period.<\/span><\/p><p class=\"ng-star-inserted\"><strong class=\"ng-star-inserted\"><span class=\"ng-star-inserted\">Article 14 \u2013 Complaints Procedure<\/span><\/strong><br class=\"ng-star-inserted\" \/><span class=\"ng-star-inserted\">Complaints about the execution of the agreement must be submitted fully and clearly described to the entrepreneur within 2 months after the consumer has discovered the defects.<\/span><\/p><p class=\"ng-star-inserted\"><strong class=\"ng-star-inserted\"><span class=\"ng-star-inserted\">Article 15 \u2013 Disputes<\/span><\/strong><br class=\"ng-star-inserted\" \/><span class=\"ng-star-inserted\">Agreements between the entrepreneur and the consumer are exclusively governed by Dutch law.<\/span><\/p><p class=\"ng-star-inserted\"><strong class=\"ng-star-inserted\"><span class=\"ng-star-inserted\">Article 16 \u2013 Additional or Deviating Provisions<\/span><\/strong><br class=\"ng-star-inserted\" \/><span class=\"ng-star-inserted\">Additional or deviating provisions may not be to the detriment of the consumer and must be recorded in writing.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t","protected":false},"excerpt":{"rendered":"<p>General
